Terms of Service

Last updated: 2025. These Terms of Service ("Terms") govern your use of the MedEscort China website and the concierge services we provide. By engaging our services, you agree to these Terms.

Please also read our Privacy Policy and Medical Disclaimer. They form part of your relationship with us.

1. Who we are

MedEscort China ("we", "us", "our") is an independent medical concierge. We arrange, interpret and accompany — we do not provide medical advice, diagnosis or treatment, and we are not a hospital, clinic or insurance company. The clinical services you receive are provided by licensed hospitals and physicians, who are independent of us.

2. Services we provide

Subject to a written agreement, we may provide:

  • Online consultation arrangement with Chinese specialists.
  • Records review and translation.
  • Airport pickup and drop-off.
  • Accommodation and meal coordination.
  • Medical interpreting in consultations, procedures and discharge.
  • Hospital escort and patient advocacy.
  • Light sightseeing and family support during recovery.
  • Post-return remote follow-up coordination.

The specific services for your engagement are listed in the contract or booking confirmation we send you.

3. Your obligations

When you engage our services, you agree that you will:

  • Provide accurate, complete information about your medical condition, history and medications.
  • Disclose any infectious disease, behavioral condition or other factor that may affect hospital staff or other patients.
  • Obtain appropriate travel insurance covering medical treatment abroad and emergency evacuation for the duration of your trip.
  • Comply with Chinese law, hospital rules and the reasonable instructions of your treating physician.
  • Pay our service fee on time as agreed in the contract, and settle medical charges directly with the hospital.
  • Treat our staff and partners with respect. We will do the same.

4. Payment terms

  • Our service fee is stated in your contract, in the currency you select.
  • A deposit (typically 30%) is due on signing to confirm hospital and accommodation slots.
  • The balance of our service fee is due on arrival, before your first in-person appointment.
  • We never handle medical fees. Hospital, imaging, pharmacy and procedure charges are invoiced by the hospital in its own name and paid by you directly at the hospital cashier. We will escort you there and interpret, but we do not advance, collect, hold or settle medical fees on your behalf, and we add no mark-up to them.
  • Our service fee is invoiced by us for our services only. Any invoice you receive from us covers our service fee and nothing else.
  • Additional days or services are billed at the rates in the contract and confirmed in writing before being provided.
  • Late payment may suspend services and accrue interest at the rate permitted by local law.

5. Cancellations and refunds

Our standard cancellation policy, unless otherwise agreed in your contract:

  • More than 30 days before arrival — full refund of the deposit, minus non-recoverable costs we have already incurred (e.g. cancellation fees from a booked hotel).
  • 15–30 days before arrival — 50% of the deposit is refundable.
  • Less than 15 days before arrival — deposit is non-refundable.
  • After arrival / during treatment — unused days of our service fee are refundable on a pro-rata basis. Hospital and clinic charges are governed by the hospital's own refund policy.

If you need to cancel for a medical reason supported by a doctor's note, we will refund unused portions in full and assist with any recoverable third-party costs on a best-efforts basis.

6. Medical outcomes

We do not provide medical advice, do not diagnose, do not treat and do not guarantee outcomes. All clinical decisions are made by you and your treating physician. Our role is to facilitate communication, logistics and personal support — not to make or second-guess medical decisions. Please read our Medical Disclaimer for the full statement.

7. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for the acts or omissions of any hospital, physician or other third party not directly employed by us.
  • We are not liable for any medical outcome, including but not limited to the success of any procedure, complication, side effect or unsatisfactory result.
  • Our aggregate liability for any claim relating to our services is limited to the total amount you have paid us for the engagement in question.
  • We are not liable for indirect, consequential, incidental or punitive damages.
  • Nothing in these Terms excludes liability that cannot lawfully be excluded (e.g. for personal injury caused by our negligence, where applicable).

8. Insurance

We strongly recommend that every client carries travel and medical insurance valid in China, covering the cost of treatment, emergency evacuation and repatriation. We do not provide insurance and are not liable for costs you incur that would have been covered by appropriate insurance.

9. Intellectual property

All content on this website — text, graphics, logos, icons, photos and software — is owned by MedEscort China or its licensors, and is protected by copyright and other laws. You may view and print pages for your personal, non-commercial use. You may not reproduce, redistribute or create derivative works without our written permission. Patient stories are used with the patient's written consent.

10. Your data and privacy

Our use of your personal data is described in our Privacy Policy, which forms part of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active clients and posted on this page with a new "last updated" date. Continued use of our services after a change means you accept the updated Terms.

12. Termination

We may suspend or terminate services if you materially breach these Terms, fail to pay, behave abusively toward staff or partners, or pose a safety risk. In such cases, you remain liable for services already rendered and any non-recoverable third-party costs.

13. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-laws principles. Nothing in this clause removes any mandatory protection you have under the consumer laws of your country of residence.

14. Dispute resolution

We aim to resolve any complaint quickly and fairly. If we cannot, the parties shall first attempt mediation through a mutually acceptable mediator before commencing court proceedings. If mediation fails, disputes shall be submitted to the competent courts at our registered office, unless mandatory local law requires otherwise.
